Terms of Service

1. Service description

Order57 is a pickup ordering platform for independent food shops. The Service allows shops to list products and accept pre-orders from customers for in-store pickup. Click Collect does not process payments between shops and their customers.

2. Account responsibility

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when setting up your shop. You agree to notify us promptly if you become aware of any unauthorised access to your account.

3. Free trial

New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. We will notify you before the trial ends and provide clear information about any applicable fees before charging you. You are free to cancel at any time during the trial at no cost.

4. Acceptable use

You agree to use Order57 only for its intended purpose — managing pickup orders for your food shop. You must not use the Service for any unlawful purpose, attempt to interfere with the operation of the Service, or access other users' accounts or data without authorisation.

5. Your data

You own your data. All shop information, product listings, customer details, and order history that you create or receive through the Service belong to you. We do not claim any ownership rights over your content. You may request an export of your data at any time.

6. Service availability

We strive to keep Order57 available and reliable, but we provide the Service on a "best effort" basis. We do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance and will endeavour to provide notice when possible. We are not liable for any loss resulting from service interruptions or downtime.

7. Termination

Either party may terminate the use of the Service at any time for any reason. You may cancel your account from your dashboard or by contacting us. We may suspend or terminate your account if you breach these Terms. Upon termination, your data will remain available for a reasonable period to allow you to export it, after which it will be deleted.

8. Limitation of liability

To the maximum extent permitted by Australian law, Order57 is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Indemnification

You agree to indemnify and hold harmless Order57 from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.
